Purchase Terms

These Purchase Terms (“Terms”) are effective as of 15th September 2015.

Please read these Terms carefully before purchasing any Merchandise from this website. By ordering any Merchandise from this website, you agree to be bound by these Terms. If you do not agree with any of these Terms, please do not purchase any Merchandise from this website.

Contracting Party

The site is operated by Global Trader Marketing Sdn Bhd (1152474-K) of Lot 10, Jln E1/1, Kawasan Perindustrian Ehsan, Kepong, 52100 Kuala Lumpur.

Global Trader Marketing Sdn Bhd. is an independent distributor retailer and operates the online store of various consumer goods bands in Malaysia.

When do these Terms apply?

When you order anything from this website or any websites directly connected to this website, your agreement to the Terms during the order process constitutes your acceptance of the applicability of these Terms. It is only possible to deviate from these Terms if agreed in writing by Global Trader Marketing Sdn Bhd in its sole discretion.

Offer and prices

The representations relating to the Merchandise or services on this website are without obligation and do not bind Global Trader Marketing Sdn Bhd, its suppliers and affiliates (collectively, “Global Trader Marketing”). Global Trader Marketing are likewise not bound by manifest clerical errors and mistakes in promotional descriptions and other statements referred to on this website. Minor colour and other variations in products are possible as a result of different image acquisition, display technologies or other technical reasons. Global Trader Marketing are not liable for these variations and deviations.

The stated prices include Malaysia Goods and Services Tax (GST). Prices are quoted in Ringgit Malaysia. Global Trader Marketing reserves the right to make price and product changes prior to an order placed by you is confirmed by both parties in order to allow you to decide whether you would wish to proceed with the purchase. Global Trader Marketing reserves the right to change, limit or terminate any special offers or discounts at any time.

Global Trader Marketing may charge shipping costs but with your confirmation whether you would wish to proceed with the purchase. These costs will, if applicable, be charged separately and specified and added up with the total amount of the order.

How is a contract concluded with you?

You have to be at least 18 years of age or older to buy products via this website.

Orders you place through this website are only an invitation to you to conclude a sales contract. The sales contract is only concluded upon the confirmation by Global Trader Marketing e-mail to you via Interbase Resources SDN BHD (the operator of this website). Until you receive this confirmation, you can still cancel the order.

You warrant that the information you provide to Global Trader Marketing in the request or order is accurate and complete. Global Trader Marketing is never obliged to accept an order. Global Trader Marketing is entitled at all times to verify an order in advance or to refuse an order without providing reasons. If Global Trader Marketing does not confirm your order within 3 business days, it is deemed to have been refused.

Delivery

Global Trader Marketing will deliver to the address indicated by you only within Malaysia. Global Trader Marketing can only deliver to a delivery address which is a home or office address. Deliveries will be done on business days and during business hours (9 am to 5 pm), not being a weekend or a public holiday, in Malaysia.

Global Trader Marketing is entitled, insofar as reasonably possible, to make split deliveries so that you receive the ordered products as soon as possible. There are no additional costs associated with such split deliveries. However, in the event that you request that Global Trader Marketing deliver the order in parts, Global Trader Marketing may charge you for extra delivery costs. Each split order shall constitute a separate sales contract.

Options in case of delivery problems

If Global Trader Marketing discovers prior to entering into the sales contract that it can no longer deliver the ordered Merchandise, Global Trader Marketing may offer you an equivalent product in terms of quality, price and function. You are not obliged to accept the replacement product. You may cancel your purchase upon notifying Global Trader Marketing.

If Global Trader Marketing discovers after entering into the sales contract that Global Trader Marketing can no longer deliver the ordered products, Global Trader Marketing will be entitled to terminate the sales contract. Global Trader Marketing will inform you immediately and reimburse any payments made.

Methods of payment

Please check lelong.com.my for information on available payment methods. Global Trader Marketing accepts payments via credit cards and will use NetPay which acts as an independent third payment service processor. Global Trader Marketing shall not be liable for any breach, act or omission of NetPay. and its service provider(s).

Global Trader Marketing reserves the right to cancel orders or terminate the sales contract if fraud or other criminal activity is detected.

Use and storage of Merchandise

Global Trader Marketing draws your attention to the conditions of use instructions printed on the labels of the Merchandise. Global Trader Marketing is not liable for any damage resulting from the incorrect use, storage or handling of Merchandise, including such other use, storage or handling that is contrary to the instructions.

Returns and Refunds for Damaged and Defective Merchandise

Quality is paramount and returned Merchandise on the basis that it is damaged or defective will be inspected.

If there is any damage to the Merchandise as a result of a manufacturing defect or deviation from factory specifications, we shall exchange the damaged or defective Merchandise with a new Merchandise or provide you with a full refund.

If the defect in the Merchandise was caused by factors other than manufacturing defects within our control (e.g., during the course of delivery), we will not provide you with a refund but we will exchange the defective Merchandise with a new Merchandise.

• There shall not be any exchange or refunds for Merchandise:Obtained from a source other than http://www.lelong.com.my/merchant/scholl/
• Damaged by abuse or negligence, exposure to chemicals, caustic substances, open flame, high heat, sharp object, usage not within manufacturer’s or supplier’s guidelines
• Damaged by misuse or activities other than the intended purpose

Warranties and Liability

To the maximum extent permitted by law, Global Trader Marketing excludes all conditions, warranties and guarantees (whether express or implied by or arising under statute, common law, equity, trade custom or usage or otherwise), and makes no representations, relating to the products ordered by you, including warranties or guarantees of acceptable quality, merchantability and fitness for purpose. Nothing in these Terms excludes limits or modifies any conditions, warranties or guarantees implied by or arising under statute which cannot lawfully be excluded.

Where conditions, warranties or guarantees implied by or otherwise arising under law cannot be lawfully excluded, then to the extent permitted by law, Global Trader Marketing liability for a breach of any such condition, warranty or guarantee is limited, at the absolute option of Global Trader Marketing to the exchange of the products or the supply of equivalent products or the cost of replacing or of acquiring equivalent products.

Otherwise, to the maximum extent permitted by law, of Global Trader Marketing, and/or their respective officers, employees, agents and representatives will not be liable for any loss or damage (including, but not limited to, any loss of profit, loss of sales, loss of market, loss of goodwill or reputation, third party claims, incidental or special damages or indirect or consequential loss or damage of any kind) to any person or entity, however caused (whether by negligence or otherwise), which may arise directly or indirectly from or in connection with these Terms, this website or any orders you place via this website.

Retention of title

The delivered Merchandise will remain the property of Global Trader Marketing (or as otherwise specified in the relevant agreement between Global Trader Marketing Sdn Bhd. and its supplier until you have paid all amounts owing under any agreement to us via the payment platform, in full, including the payment of costs, even of earlier or later deliveries or partial deliveries. You undertake not to sell, dispose of or encumber Merchandise before ownership thereof has passed to you.

Applicable law

These Terms are governed by the laws of Malaysia, and you irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Malaysia.
